1. Acceptance of Terms

By accessing or using Glowtify's Services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Services.

2. Definitions

  • Client / You: Any individual or entity using the Services
  • Software: The Glowtify platform and all related services
  • License: The right to access and use the Software
  • Authorized Use: Permitted use under these Terms
  • Connectors: Third-party integrations (Shopify, Google, Meta, etc.)
  • Subscription: Paid access plan to the Software

3. SaaS License Grant

Glowtify grants you a non-exclusive, non-transferable, revocable license to access and use the Software during your active subscription, subject to these Terms.

4. Client Obligations

You agree to:

  • Use the Software lawfully
  • Maintain confidentiality of access credentials
  • Ensure compliance with data protection laws
  • Obtain all required consents for Customer Data
  • Not misuse, reverse engineer, or resell the Software

5. Glowtify Obligations

Glowtify agrees to:

  • Provide the Services with reasonable care
  • Maintain security and confidentiality
  • Comply with applicable data protection laws

6. Subprocessors

Glowtify may engage subprocessors to deliver Services. Glowtify remains responsible for their compliance.

7. Data Processing Agreement

Glowtify's Data Processing Agreement (DPA) forms an integral part of these Terms and governs Personal Data processing in accordance with GDPR and applicable laws.

8. Payments & Subscriptions

  • Fees are billed according to your selected plan
  • Subscriptions renew automatically unless canceled
  • Fees are non-refundable unless required by law

9. Termination

Glowtify may suspend or terminate access if:

  • These Terms are breached
  • Required by law
  • Services are discontinued

You may cancel your subscription at any time.

10. Limitation of Liability

To the maximum extent permitted by law:

  • Glowtify shall not be liable for indirect, incidental, or consequential damages
  • Total liability shall not exceed fees paid in the previous 12 months

11. Disclaimer

The Services are provided "as is" and "as available" without warranties of any kind.

12. Governing Law

These Terms are governed by the laws of Quebec, Canada, without regard to conflict of law principles.
